Business Leases and Renewals

A Business Lease is the letting of a building or part of a building or open land for business purposes. It has to be borne in mind that Business Leases are generally put in place for a number of years with the Tenant having the right to apply to the Court for the grant of a new Lease once it has expired unless such provisions are excluded at the outset of the original Lease. We can advise and guide Landlords and Tenants on such Leases.

Advising on Terms of Leases

Where a Lease has already been created we can advise you on your rights and obligations. By way of example what is included within the definition of the property boundaries, the obligation to pay service charge, rent review, repair, decoration, alteration of the premises and assigning or transferring an interest in property.

Commercial Property Case Studies

Purchase of Commercial Property
We were instructed by a Pension Fund on the purchase of a substantial commercial property with a strict timescale. Notwithstanding a number of complexities and the mortgagees’ Solicitors imposing a number of unrealistic and unreasonable requirements the transaction was satisfactorily completed.

Sale of Commercial Property
Goldwaters were instructed on the sale of a large commercial property which included the preparation of a commercial sale agreement retaining valuable capital allowances. As the property was sold subject to a commercial lease the agreement included clauses designating the sale as a ‘going concern’ which enabled the purchaser to complete without having to pay VAT in addition.

New Lease
We acted for a landlord on the grant of a complex lease to a tenant. It meant investigating title, preparing the lease for approval and answering substantial commercial and other enquiries. The matter was satisfactorily completed.

Lease Renewal
On behalf of a landlord we served a six months Section 25 Notice determining the existing contractual lease. This enabled commercial surveyors to agree the heads of a new lease at a higher rent. We then prepared and negotiated a new lease and progressed matters to completion.
