Property Litigation Case Studies

Ownership of property legally owned by another
We received instructions from a client who was living in a property legally owned by another. She stated the parties had originally got on well and monies due to her were spent on a property they jointly purchased but in her opponent’s sole name. Only she lived in the property. Several years later the opponent sought to evict her. Despite various attempts through ourselves to resolve the matter through negotiation he failed to do so. We had put forward an offer of £180,000 at an early stage being one half share of the equity. This was accepted a few days before the trial with the opponent having to pay substantial costs which could otherwise have been avoided.

Right of Way
Goldwaters were instructed on a dispute over a right of way blocked by a neighbour’s car. Initially the neighbour was ‘in denial’ on the terms of the right of way and incorrectly advised by his Solicitors on the interpretation of certain documentation. However through negotiation and meetings on site between the parties and their Solicitors (by which time both sides had obtained advice from barristers) the matter was resolved without the need for Court proceedings or significant costs being incurred. Good relations between the commercial property owners was restored.

Recovery of Commercial Rent
We have often been instructed to recover rent, service charge, insurance and other outgoings payable by the tenant. The matter can usually be resolved by negotiation and on some occasion through Court proceedings. Where the claim relates solely to rent a commercial High Court Enforcement Officer has been instructed to recover the rent through CRAR on giving seven days notice but without having to go through the Court process.

Setting Aside a Transaction at Undervalue
Goldwaters were instructed by a landlord where the guarantor had transferred a property owned by him at an undervalue to a relative. The landlord believed this had been done to avoid paying creditors. Following High Court proceedings and a trial the property was transferred from the relative for the benefit of creditors.
